I purchased an automobile that I believe is a lemon – what are my rights?
Consumers who have purchased a defective new or used vehicle from a dealer may be entitled to a replacement vehicle or a refund under the New York State Lemon Law.
Currently, New York State has a New and Used Car Lemon Law. New automobiles are covered for 2 years or 18,000 miles; used automobiles receive a warranty period of
30, 60, or 90 days, depending on the mileage at the time of purchase. The New York State Consumer Protection Board’s
Consumer Law Help Manual (CLAHM) explains in further detail the specific criteria
that must be met in order to receive Lemon Law protection.
Also, the NYS Department of Motor Vehicles (DMV) licenses automobile repair shops.
All complaints involving faulty repair work, gross overcharging, failure to provide an
invoice, etc. should be referred to the DMV.
